Terms and Conditions

These Terms and Conditions ("T&Cs") govern your access to and use of our website, as well as the purchase of our WAYOU Daily Mist 15ml ("Product") from WAYOU SINGAPORE PTE. LTD. ("we", "us", or "our"). By accessing our website, placing an order, or using our Product, you agree to be bound by these T&Cs and our Privacy Policy, which together form a legally binding agreement.

If you do not agree with these T&Cs, please refrain from using our website or purchasing our Product.

1. Eligibility

You must be at least 18 years of age and legally able to enter into binding contracts in order to use our website and purchase the Product. Our website is intended for personal use only and must comply with all applicable laws and regulations in Singapore.

Users outside Singapore must ensure compliance with their local laws.

We reserve the right to suspend or terminate access to our website for any user who violates these T&Cs or engages in harmful activities.

2. Orders and Product Information

Our Product is intended for external cosmetic use only. Please carefully follow the instructions, warnings, and guidelines provided on our product packaging. Detailed product information, including detailed directions for use and safety guidance, is available digitally via the QR code located inside the packaging.

While we make every effort to ensure the accuracy of product descriptions, images, and specifications, minor variations may occur (such as changes in colour or packaging). These variations are not considered defects.

Placing an order constitutes an offer to purchase. Your order will only be considered accepted when you receive an order confirmation email or when the Product is dispatched.

We reserve the right to cancel or refuse orders due to stock unavailability, pricing errors, concerns regarding fraud, or for any other reason at our discretion. Estimated delivery times are provided for convenience and may be affected by factors outside our control.

3. Personal Use Only

Our Products are sold for personal use only. You may not resell, distribute, or use the Product commercially without our prior written consent. This ensures product quality and compliance with Singapore law and regulations.

  • If purchasing for someone else (e.g., as a gift), you confirm that the recipient will follow these T&Cs, instructions, and warnings.
  • We reserve the right to cancel future orders or refuse service if we reasonably believe you are reselling without authorization.
  • Breaching this condition may result in legal action for breach of contract.

We do not permit unauthorised resellers. For reseller inquiries, please contact us for official agreements.

4. Pricing, Payment, and Shipping

All prices on our website are listed in Singapore Dollars (S$) and may include or exclude Goods and Services Tax ("GST"), as indicated at checkout.

Prices exclude customs duties, import taxes, tariffs, brokerage fees, credit card or bank transaction fees, and any other charges imposed by authorities in the destination country. Any such duties, taxes, or fees are the sole responsibility of the customer and must be paid directly to the relevant authorities or courier upon delivery.

If you fail or refuse to pay any duties, taxes, or fees and the Product(s) are returned to us, held by customs, abandoned, or destroyed, no refunds will be issued by us. We may retain returned Product(s) and/or all payments as compensation.

For user convenience, our website supports switching between multiple currencies. However, all transactions are processed in S$ with conversions applied automatically based on your selected local currency at the time of checkout. Exchange rates are determined by third-party payment processors and may include fees.

We may update prices at any time, but once an order is confirmed, the price will be locked in and cannot be changed. Payments are processed only through approved methods. By using your selected payment method, you confirm that you are authorised to make the payment.

Shipping costs, delivery zones, and estimated delivery times will be displayed at checkout. Estimated delivery times from the date the order is placed are as follows:

  • Orders within Singapore: 1 – 2 business days
  • Orders to countries other than Singapore: 7 – 14 business days (depending on destination)

Orders are fulfilled from either our Singapore facility or regional distribution centres, depending on the delivery destination. While Products are manufactured in South Korea, shipping origin may vary based on your location.

Refunds under Clause 5 are processed in S$ using the exchange rate applicable at the time of approval. While we regret any inconvenience from currency fluctuations or bank fees that may reduce the final amount received, our liability is limited to the approved S$ value, in line with standard industry practices.

5. Returns and Refunds

We strive to ensure that you are completely satisfied with your purchase. Due to the nature of our Products, we have a no returns policy. Refunds and exchanges are only available in the following limited situation:

a. Defective Products Exchange or Refund Policy If you discover a manufacturing defect (e.g., a broken spray nozzle or malfunctioning pump) within 14 days of receiving your Product, you may at your election be eligible for an exchange or refund. To proceed:

  • Record a short video showing the defect or malfunction; and
  • Submit the video to our Customer Service team for verification.

Upon verification of the defect, we will arrange an exchange or refund of the defective item within 30 business days of verification.

b. Exclusions and Limitations

  • For safety and hygiene reasons, we cannot accept returns on any cosmetic products. Once purchased, no Product returns will be accepted under any circumstances.
  • This policy does not apply to defects resulting from misuse, accidental damage, or normal wear and tear.

6. Your Responsibilities

By using our website and purchasing our Product, you agree to:

  • Follow all product usage instructions, warnings, and guidelines provided with the Product.
  • Discontinue use immediately and consult a healthcare professional if irritation or discomfort occurs.
  • Verify the suitability of the Product for your needs (e.g., allergies) and seek professional advice if necessary.
  • Not resell or distribute the Product for commercial purposes without our written permission. The Product is intended solely for personal use.

7. Customer Reviews and Feedback

We welcome customer feedback and reviews about our Products. By submitting a review, you grant us a perpetual, worldwide license to use, modify, and display your review for promotional purposes. We reserve the right to remove any reviews that violate our content policies or are deemed inappropriate.

8. Limitation of Liability

8.1 Non-Excludable Liability Nothing in these T&Cs excludes or limits liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability that cannot be excluded or limited under the Unfair Contract Terms Act 1977 ("UCTA") or applicable law.

8.2 Product Testing and Safety Our Products have undergone independent clinical testing and are described as "low irritation" and "hypoallergenic (safe for sensitive skin)" based on test parameters. However, such tests are conducted on sample groups under controlled conditions and do not guarantee no adverse reactions in every user.

The Products are notified to the Health Sciences Authority of Singapore as required by law, and are designed, tested, manufactured, and quality-controlled in compliance with applicable safety and regulatory standards.

8.3 Allergic Reactions and Individual Sensitivities You acknowledge that individual reactions to cosmetic products vary widely, including due to skin types, medical conditions, allergies, or interactions with other products or medications. We are not liable for such reactions under the following conditions:

  • the Product was not used in accordance with our instructions or warnings;
  • the user did not perform a patch test or follow first-use precautions;
  • the adverse reaction is due to a pre-existing condition, allergy, or interaction with other products; or
  • we have adhered to relevant safety and quality standards.

To the extent permitted by law, our liability for claims related to allergic reactions or irritation is limited to the price paid for the Product that gave rise to the claim.

8.4 Product Liability Insurance We maintain product liability insurance with a reputable insurer for coverage of certain product-related claims, subject to these T&Cs.

8.5 Exclusion of Resale Guarantees If you purchase a Product for resale or commercial use, you are responsible for ensuring that the onward purchaser or user receives all applicable product information, instructions, and warnings. We are not liable for any claims arising from the resale, distribution, marketing, or modification of the Product by you or any third party.

8.6 Reasonableness All liability exclusions and limitations in these T&Cs apply only to the extent permitted by UCTA and other applicable laws.

9. Product Use Disclaimers

Our Product is intended for external cosmetic use only. Any use outside the specified instructions or warnings, including mixing with unapproved products, is at your own risk. We are not liable for any adverse reactions, injuries, or other issues resulting from improper use.

While we ensure regulatory compliance, individual results may vary.

If you are pregnant, breastfeeding, or have any medical conditions or sensitivities, we recommend consulting a healthcare professional before use. For safety reasons, our Products are not recommended for use on children.

10. Intellectual Property

All content on our website, including text, images, logos, and designs, is our property and/or our licensors. You may view and print the content for personal, non-commercial use only. Reproduction, distribution, or any other commercial use of this content is strictly prohibited without our prior written consent.

11. Privacy

Your use of our website and purchase of our Product involves the collection and processing of personal data, which we handle in accordance with our Privacy Policy. By purchasing from us, you consent to the collection and use of your personal data as outlined in the Privacy Policy.

12. Amendments

We reserve the right to update or modify these T&Cs and any other content on our website at any time. Any changes will be effective immediately upon posting. By continuing to use our website after any updates, you accept the revised T&Cs. If any significant changes affect your order, we will notify you and provide remedies where required.

13. Fraud Prevention and Security

We reserve the right to cancel or suspend orders that appear fraudulent or suspicious, including, but not limited to, orders made with stolen credit cards or multiple unsuccessful payment attempts. If fraudulent activity is detected, we may report it to the appropriate authorities.

14. Governing Law

These T&Cs are governed by and construed in accordance with the laws of Singapore. Any disputes arising from or related to these T&Cs will be subject to the exclusive jurisdiction of the courts of Singapore, except in cases where urgent relief is required.
